HL Deb 02 February 1987 vol 484 c125WA
Baroness David

asked Her Majesty's Government:

Whether there is any statutory authority for the Nature Conservancy Council to de-notify a site of special scientific interest.

Lord Skelmersdale

Sites which were notified as SSSIs under the National Parks and Access to the Countryside Act 1949 which in the opinion of the Nature Conservancy Council are no longer of special interest are not renotified under the Wildlife and Countryside Act 1981. For sites first notified under the 198 I Act, the NCC is required to consider representations and objections and to decide within nine months of notifying a site whether the notification should be confirmed. If not confirmed, the notification ceases to have effect at the end of the nine month period. In addition, the Nature Conservancy Council advises owners and occupiers of the land concerned and local planning authorities if having been notified, the site ceases for any reason to be of special interest.
