asked the Secretary of State for the Environment if he will summarise the results of his Department's review of the operation of the control of Pollution Act 1974 as it effects noise nuisance; and if he will make a statement.

The outcome of the review of local authority practice and court decisions on statutory nuisance (both emissions and noise) was announced in the White Paper "Building and Businesses … Not Barriers" (Cmnd. 9794).

Both local authorities and bodies representing industry, who were consulted during the review, expressed general satisfaction with the powers of the Control of Pollution Act 1974 as they related to noise. The Government do not therefore see any need at present for changes in this legislation.
