HC Deb 17 November 1986 vol 105 c68W
Mr. Stern

asked the Paymaster General if he has any plans to review the operation of legislation relating to the calling of national strikes without a ballot.

Mr. Kenneth Clarke

As a result of our 1984 Trade Union Act, unions which fail to ballot their members before calling them out on strike lose their immunity from legal action. Employers and others damaged by the action may therefore seek a court injunction and sue for damages.

Employers have shown themselves ready to use this remedy, but I continue to keep the situation under review.
