Mr. Corbett

asked the Attorney-General, whether he will institute proceedings against the proprietor and editor of The Sun under section 4 of the Sexual Offences (Amendment) Act 1976 in relation to the publication of a photograph of an alleged rape victim on 10 March.

The prohibitions contained in section 4(1) of the Sexual Offences (Amendment) Act 1976 only apply to publications and broadcasts which take place after a person is accused of a rape offence. No person has yet been accused of the offence to which the report and photograph published inThe Sun on 10 March refers and accordingly no offence is disclosed.
