§ Mr. Gryllsasked the Secretary of State for Transport what stage has been reached in the review of the working of the environmental provisions in goods vehicle operator licensing introduced in the Transport Act 1982, which was announced on 25 July 1985.
§ Mr. Peter BottomleyWe are considering the views expressed about these provisions. A statement will be made in due course.
§ Mr. Gryllsasked the Secretary of State for Transport whether the review of the working of the environmental provisions in goods vehicle operator licensing will take into account the judgment of the transport tribunal in the case of Surrey Heath borough council v. N.F. T. Distribution Ltd. (No. W.17) issued on 7 February; and whether, in the light of observations made by the transport tribunal, he plans to take steps to change the relevant primary and secondary legislation.
§ Mr. Peter BottomleyImportant issues were raised by the transport tribunal in its judgment on this case and I shall be considering these in the course in the current review of the legislation.
§ Mr. Gryllsasked the Secretary of State for Transport whether he will issue revised guidance to licensing authorities to reflect the judgment of the transport tribunal issued on 7 February in the case of Surrey Heath borough council v. N.F.T. Distribution Ltd.
§ Mr. Peter BottomleyAll the licensing authorities are aware of the transport tribunal judgment and I am sure they will have regard to it in dealing with similar cases.
