§ Mr. RifkindThe law of mobbing and rioting in Scotland was recently reviewed by the Scottish Law Commission, which issued a consultative memorandum on the subject. The commission has now concluded that there is no need to issue a report on the subject, as the present common law is adequate, and difficulties identified (principally relating to guilt by association) can be alleviated by changes in the use, and manner of libelling, of charges of mobbing and rioting. My noble and learned Friend the Lord Advocate has taken careful note of the commission's view. The commission remains ready 429W to reconsider the matter at a later date if circumstances so require. I have therefore concluded that no statutory changes are at present necessary for Scotland.
