asked the Secretary of State for Trade and Industry why the Insolvency Bill [Lords] does not include a provision to re-enact section 166 of the Bankruptcy Act 1914.

One of the major thrusts of the Bill is the prosecution of wrong doing in relation to insolvency. Section 166 of the Bankruptcy Act 1914 currently contains an exception to the general rule on the use of evidence in proceedings for bankruptcy. That exception falls with the non-re-enactment of the section.
