asked the Secretary of State for the Environment if he will list those sites where the Nature Conservancy Council considers there has been a breach of section 28(5) of the Wildlife and Countryside Act 1981; and which are the subject of prosecutions or legal proceedings.

Two prosecutions under section 28(5) have been concluded in respect of sites at Ulverscroft Valley, Leicestershire and Gwennydd Yr Afon Fach, Dyfed. Proceedings are in progress in respect of a site at Broadstone Meadow, Hereford and Worcestershire. In a further case in Scotland, the procurator fiscal decided not to proceed.

It would not be appropriate to publicise information about possible breaches of section 28(5), as this might prejudice any eventual legal action.
