Mr. Sheerman

asked the Attorney-General what guidance is issued by his Department or the Law Society on the application of regulation 33 of the legal aid regulations; and how many cases are determined by area committees each year in which regulation 33 is applied, broken down according to area and to different types of case.

The Solicitor-General

Regulation 33 of the Legal Aid (General) Regulations 1980 concerns the grant of legal aid for proceedings in which others beside the applicant himself have the same interest. Guidance on the interpretation of the legal aid regulations is issued by the council of the Law Society and is published in the "Legal Aid Handbook". A copy of the most recent (1984) edition is in the Library. Guidance on regulation 33 appears on pages 214 and 216. No statistics are kept of the numbers of legal aid applications determined under individual regulations, and the information requested, could be obtained only at disproportionate cost.
