Mr. Foulkes

asked the Secretary of State for the Environment (1) whether he has issued any certificates since 26 July under section 42 of the Control of Pollution Act 1974 to organisations or persons who made or who proposed to make applications for consent to discharge radioactive waste;

(2) whether he intends to make radioactive waste subject to section 32(1) of the Control of Pollution Act 1974;

(3) whether he has directed any water authorities to pass on to him applications for consent for discharges of radioactive waste, under section 35 of the 1974 Act;

(4) whether he has received any representations from British Nuclear Fuels Limited concerning its applications to water authorities for consent to discharge radioactive waste.

No representations have been received from British Nuclear Fuels Limited concerning applications to water authorities for discharge consents. No certificates have been issued under section 42 of the Control of Pollution Act 1974 nor have any directions been made under section 35.

As part of the next phase of the implementation programme for Part II of the Control of Pollution Act 1974, regulations, similar to those already in force in relation to the provisions which came into operation in July 1984, will be made applying the provisions of section 32(1) to the non radioactive part of a discharge of radioactive waste. The radioactive properties of such waste will continue to be controlled under the Radioactive Substances Act 1960.
