asked the Secretary of State for Scotland if he will make a statement on the outcome of his review of the law of trespass on residential premises in Scotland.

More than 40 replies were received to the consultation document which I issued on the law of trespass in Scotland. I am grateful to the bodies and individuals who provided comments. Nearly all of those consulted took the view that the existing common law and statutory provisions were adequate in Scotland and that no new criminal offence of trespass need be created. I agree with this conclusion, and do not intend to propose changes to the existing law in Scotland in relation to trespass on residential premises.
