Mr. John Morris

asked the Secretary of State for the Environment what are the factors which he would be prepared to take into account, when considering representatons made by a highway authority that essential expenditure on highway maintenance, to be made in order to comply with its statutory duty to maintain the highway and in particular urban footways, be disregarded under section 8(4) of the Local Government Finance Act 1982.

My right hon. Friend would carefully consider the representation made to him by the authority and all other relevant considerations, and he would have regard to the statutory requirement that the principles upon which expenditure is disregarded must be applicable to all authorities.
