Mr. Foster

asked the Attorney-General if he will review the laws concerning the age at which legal tenancy can be obtained; and if he will consider amendments to allow 16-year-olds to become tenants.

The Attorney-General

Although by virtue of sections 1(6) and 19 of the Law of Property Act 1925 and section 27 of the Settled Land Act 1925, a minor can only acquire an equitable interest in the property. There is no legal impediment to a minor entering into a tenancy. A Law Commission working paper on minors' contracts (No. 81) was published in March 1982 and its final report, which it is understood will deal with the question of tenancies, is expected to be published later this year.
