§ Mr. MellorThese provisions, which have now been consolidated into the Magistrates' Courts Act 1980, prevent a court from issuing a warrant of commitment or fixing a period to be served in default on the occasion of a defendant's conviction unless certain specified conditions are met. I am not aware of any problems over their operation which would require guidance to the courts.
