HC Deb 28 February 1984 vol 55 cc127-8W
Mr. Iain Mills

asked the Secretary of State for Scotland in what way persons affected may appeal against licences for tree felling issued by the Forestry Commission.

Mr. John MacKay

The party to whom a felling licence is granted by the Forestry Commissioners may appeal to the appropriate forestry Minister against any replanting conditions that have been imposed. The appeals procedure is set out in section 16 of the Forestry Act 1967.

There is no provision for an appeal by a third party against the granting of a felling licence. However, the Forestry Conunissioners seek the views of the local authority before taking decisions on licence applications relating to areas where the local authority has expressed a wish to be consulted.
