asked the Attorney-General whether the services of his Department are available to the Audit Commission should it request legal advice.

The Attorney-General

No. The Local Government Finance Act 1982, which established the Audit Commission, expressly provides that the commission is not to be regarded as acting on behalf of the Crown and that neither the commission nor its members, officers or servants are to be regarded as Crown servants. The Law Officers are precluded by the terms of their appointment from giving advice to anybody other than the Crown and it is therefore not possible for them to advise the commission.
