HC Deb 17 December 1984 vol 70 cc9-10W
Dr. Marek

asked the Secretary of State for the Home Department whether the Data Protection Registrar will be made aware of the existence of any certificate which exempts personal data under section 27 of the Data Protection Act.

Mr. Waddington

Part IV of the Data Protection Act 1984 exempts a number of categories of personal data from the provisions of the Act, including data whose exemption is required for the purpose of safeguarding national security: in no case does the Act require the registrar to be made aware of data to which an exemption is being applied. If any question were to arise whether data were properly exempt under section 27 a certificate would at that point need to be produced to justify the exemption.
