HL Deb 26 July 1983 vol 443 c1521WA
Lord Avebury

asked Her Majesty's Government:

What is their policy on the readmission to the United Kingdom of Commonwealth citizens who serve custodial sentences of more than two years overseas, where the individuals concerned originally came to Britain as dependent children with indefinite leave to remain here.

Lord Elton

Paragrphs 56, 57, 77 and 83 of the Immigration Rules (HC 169) are relevant to applications of this kind. Among matters to be taken into account are the date on which the individual first settled in this country, the length of time he had been away before the sentence was imposed, and the nature of the offence which led to it. If the noble Lord has a particular case in mind, perhaps he would write to us about it.
