Mr. Steen

asked the Secretary of State for Transport when his Department served a notice on the South Hams district council ordering it to remove two road traffic signs situated on the grass verge of the A38 which read "Welcome to South Hams"; under what statutory authority the notice was served; upon whom the notice was served; and if he will publish it in the Official Report.

A notice under section 143 of the Highways Act 1980 was served on the South Hams district council on 26 May. The notice is as follows:

DEPARTMENT OF TRANSPORT HIGHWAYS ACT 1980 NOTICE South Hams District Council Follaton House Plymouth Road TOTNES Devon TQ9 5NE The Secretary of State for Transport, being the highway authority for the Trunk Road (hereinafter referred to as "the highway"), in exercise of his powers under sectoin 143 of the Highways Act 1980 (a) and of all other powers enabling him in that behalf, by this notice REQUIRES you to remove the structure specified in Schedule hereto from the highway within a period of twenty eight days calculated from the date of service of this notice.
