Which sections of the Criminal Justice Act 1982 are now in force.
§ Lord EltonThe provisions of the Criminal Justice Act 1982 now in force are those which, by virtue of Section 80(1), came into force on the date of Royal Assent, namely: Section 32 (early release of prisoners) and Section 33 (power to alter the minimum period for eligibility for release on parole) which confer powers not yet exercised; the associated provisions in Schedules 14, 16 and 17; Section 57 (statutory provision for the appointment of Her Majesty's Chief Inspectors of Prisons); Sections 74 and 75 (construction of references to "statutory maximum" and "the standard scale"); Section 76 (financial provision); Section 80 (commencement); and Section 81(citation and extent).
The following provisions of the Act will come into force on 31st January:

Sections 26–28 (sanctions against parents and guardians); Section 30 (partly suspended sentences); Section 31 (activation of suspended sentence); Section 34 (computation of sentences); Section 52 (reciprocal execution of warrants of commencement for non-payment of sum adjudged to be paid by conviction); Section 63 (deferment of sentence); Section 64 and Schedule 10 (persons recommended for deportation); Section 65 and Schedule 11 (probation and after-care); Section 66 (right of appeal against probation, discharges and associated ancillary orders); Section 67 (compensation orders); Section 70 (abolition of imprisonment for vagrancy offences); together with other related and minor provisions in Schedules 14 and 15 (minor and consequential amendments), Schedule 16 (repeals) and Schedule 17 (transitional provisions).
Section 71 (abolition of imprisonment for loitering and soliciting for purposes of prostitution); Section 73 (recall of witnesses); Sections 35–50 and Schedules 2–7 dealing with maximum summary fines (together with the relevant provisions in Schedules 14–17) will come into force on llth April.
It is our intention to bring the remaining provisions of the Act into force in the second quarter of this year, and we will make a further announcement about this in due course.
