§ Mrs. FennerThe Food and Drugs Acts prohibit false or misleading labelling and the Trade Descriptions Act 1968 prohibits misleading descriptions; the responsibility for enforcement in both cases lies with local authority trading standards departments. The question of whether the term "English gin" is false or misleading is something which only a court could decide having regard to the circumstances in a particular case. However, it seems unlikely that gin produced in Scotland would be considered to qualify as English gin.
