asked the Minister of Agriculture, Fisheries and Food in what circumstances his Department permits "English gin" to be so described if it is distilled, rectified and bottled in Scotland.

The Food and Drugs Acts prohibit false or misleading labelling and the Trade Descriptions Act 1968 prohibits misleading descriptions; the responsibility for enforcement in both cases lies with local authority trading standards departments. The question of whether the term "English gin" is false or misleading is something which only a court could decide having regard to the circumstances in a particular case. However, it seems unlikely that gin produced in Scotland would be considered to qualify as English gin.
