Mr. Arthur Lewis

asked the Secretary of State for the Home Department whether he will give, for the longest and most convenient stated period of time, the total number of persons sentenced to custodial or medical treatment for mental disorder on being found guilty of stealing a car in similar circumstances to those of Michael Fagan.

The readily available information on sentences or orders imposed for offences of "theft or unauthorised taking of a motor vehicle" is published annually in "Criminal Statistics, England and Wales"—offence classification 48; tables S1.1(A) of volume 1 and S2.1(A) of volume 2 of the "Supplementary tables" for 1980 and 1981; tables 1 (a) and 5 (a) of the Command Paper for 1979 and earlier years. The published tables for magistrates courts show hospital orders made under section 60 of the Mental Health Act 1959—column 13 of table S1.1(A)—and those for the Crown court show hospital orders made under section 60 and restriction orders made under section 65—columns 13 and 14 of table S2.1(A).
