asked the Secretary of State for Employment whether, in the light of codes of practice issued by the Advisory, Conciliation and Arbitration Service, he is satisfied with the operation of sections 27 and 28 of the Employment Protection (Consolidation) Act 1978; and whether he has any plans to seek amendment of these provisions.

In general, I am satisfied with the operation of the sections referred to. I am however aware that the Court of Appeal is shortly to hear an appeal against a decision of the employment appeal tribunal relating to a complaint under section 27. I propose to look again at the issue in the light of the court's judgment and to continue to watch carefully the developing case law on the section.
