§ Mr. Arthur Lewisasked the Secretary of State for the Home Department whether he will deport Chadwick Bailor and Mervin Bailor.
§ Mr. RaisonMervin and Chadwick Bailor were convicted at Winchester Crown court on 16 February 1982 for demanding money with menaces. They were each sentenced to three years' imprisonment and recommended for deportation.
Section 6(6) of the Immigration Act 1971 precludes my right hon. Friend from making a deportation order on the recommendation of a court so long as an appeal or further appeal is pending; or until the expiration of the time for bringing an appeal. Where a person is sentenced to a tIn-m of imprisonment he would not normally consider a recommendation for deportation by the court until towards the time that person was due for release.
