asked the Secretary of State for the Environment whether he will seek to amend the Town and Country Planning Act 1971 to prevent private developers applying for planning permission over land they do not own, without the consent of the owners of the land.

Section 27 of the 1971 Act already requires an applicant for planning permission to notify the owners of the land of the application and section 29 requires the local planning authority to take into account any representations relating to the application made to them by the land owners. In addition, the grant of planning permission does not in any way whatsoever confer any rights to develop or use land without the owner's consent.
