§ Mr. Carter-Jonesasked the Secretary of State for Social Services if he will list in the Official Report any statutory powers which require local social services authorities to provide home help for households where such help is required owing to the presence of persons who are handicapped as a result of having suffered from illness or by congenital deformity, and any default powers he possesses in the event of a failure by the local authority to meet this requirement, any other provisions relating to this requirement and the number of occasions on which local authorities have been required to fulfil any statutory obligation placed upon them in this connection.
§ Mr. RossiThe relevant statutory provisions are:
(a) Section 21 and Paragraph 3 of Schedule 8 of the National Health Service Act 1977. Default powers are in Section 85 of that Act.
(b) Section 2(1)(a) of the Chronically Sick and Disabled Persons Act 1970 and Section 29 of the National Assistance Act 1948. Default powers are in Section 36 of the 1948 Act.
I know of no cases in which default orders have been made in this connection.
