asked the Solicitor-General for Scotland what is his policy on initiation of prosecutions under the Solway Act 1804.

Any case alleging the commission of a criminal offence which is referred to the procurator fiscal will be considered and a decision whether or not to prosecute will be taken on the merits of that particular case.
