§ Mr. Gordon Wilsonasked the Secretary of State for Scotland if he is satisfied that local authorities have adequate planning powers to prevent the spread of sex shops in Scotland; and, if not, if he will introduce any necessary amending legislation.
§ Mr. RifkindOffences relating to the display, publication, distribution and sale of indecent or obscene material are covered in the Burgh Police (Scotland) Act 1892 and related local Acts. In some circumstances such offences can also be charged at common law. Planning controls would apply only if a new building was involved.
