§ Mr. Kilfedderasked the Secretary of State for Northern Ireland whether any enactments of the former Northern Ireland Parliament have been challenged on the grounds that they discriminated against persons on the grounds of religious belief; and, if so, what was the result.
§ Mr. PriorFrom an examination of the usual index to the cases reported in the Northern Ireland law reports, I am aware of only one such case—Londonderry city council v. M'Glade (1929; NI 47). In that case, certain provisions of the Education Act (Northern Ireland) 1923 were challenged on the grounds that they infringed the prohibition, contained in section 5(1) of the Government of Ireland Act 1920, against discrimination in legislation on the grounds of religious belief. This challenge failed in the Chancery division of the High Court and no appeal was lodged.
