Whether they will give the text of the guidance notes currently issued by the Department of Health and Social Security on the repatriation of mentally ill people under Section 90 of the Mental Health Act 1959 and Section 29 of the Commonwealth Immigrants Act 1971 respectively, and when these notes were last updated.
§ Lord CULLEN of ASHBOURNEGuidance on Section 90 of the Mental Health Act 1959 was given in paragraphs 277 and 278 of the Memorandum on Parts I, IV to VII and IX of the Mental Health Act 1959 and in paragraphs 4 to 7 of the Ministry of Health Circular HM (61)110. These documents were issued in 1960 and 1961 respectively and neither has been updated. Copies have been placed in the Library. The Department of Health and Social Security has issued no guidance on Section 29 of the Immigration Act 1971, but there is a Home Office Circular (No. 244/1971) which deals with this. A copy has been placed in the Library.
