Mr. Higgins

asked the Secretary of State for the Home Department, in the light of the decision of the Divisional Court in the case of Rumbles v. Poole, what action he proposes to take with regard to those motorists whose licences have been incorrectly endorsed for failing to comply with a traffic warden's directions, especially those disqualified under the totting-up rules; and whether compensation can be paid in cases where loss was sustained as a result of such uncertainty in the law.

It is not the practice to reopen cases decided on a view of the law which the High Court has subsequently declared to be erroneous.
