Mr. R. C. Mitchell

asked the Secretary of State for Social Services what is his Department's policy as to the payment of unemployment benefit to persons who have received private redundancy payments from their former employers.

Entitlement to unemployment benefit is not affected where the independent adjudicating authorities, who decide all claims for benefit, are satisfied that the true nature of a payment made by an employer is solely to provide compensation for redundancy. Each case is decided in the light of the individual circumstances and in accordance with the Social Security Act 1975, regulations and case law derived from commissioners' decisions.
