asked the Secretary of State for Social Services if a resident living in an aged persons home maintained by a local authority has any right of tenure in that home, or if such residents are protected from being moved to an alternative home without their express permission; and what guidance his Department gives to local authorities on this matter.

An elderly person residing in an old people's home maintained by a local authority under the provisions of section 21 of the National Assistance Act 1948 has no right of tenure.

The move of a resident from one home to another would be a matter for those staff of the local authority most closely concerned with his welfare. In practice, this would rarely occur without the consent of the person concerned. The Department has given no guidance to local authorities on this matter.
