35. Mr. Arthur Davidson

asked the Attorney-General what consultations he has had with the Director of Public Prosecutions about handing back to those convicted of drugs offences as a result of Operation Julie the proceeds of their crime, in the light of the recent judgment by the House of Lords.

The Attorney-General

I have discussed with the Director his legal position following the House of Lords' judgment, and as a result of those discussions the Director does not propose to hand back any property which was the subject of the forfeiture order otherwise than on the order of a court; and he will defend any application for such an order.
