§ Mr. Gordon Wilsonasked the Solicitor-General for Scotland what the current procedure is, and if there has been any alteration in recent months, whereby the Crown Office marks the papers on complaints against police officers.
§ The Solicitor-General for Scotland; Reports are read in the first instance by an Advocate Depute—normally the Home Advocate Depute—who thereafter sends the papers to one of the Law Officers with his recommendation for or against proceedings, unless he considers that the complaint is entirely without substance in which case he will himself instruct no proceedings. The decision of the Law Officers is final.
There has not been any alteration in recent months.
