§ Mr. Jim LesterThis order provides for a lower minimum rate for "service" workers who have a written agreement with their employers that their gratuities will be made up to a specified minimum amount.
Wages inspectors check wages paid by examining records and interviewing workers. Any written agreements concerning gratuities are examined. If, after due warning, the employer has not entered into a written agreement, the higher rate is strictly enforced.
