Whether they will define the phrase "without recourse to public funds" used in the draft Immigration Rules (Cmnd. 7750); and in particular, whether a person who seeks access to any service such as education or medical treatment which is provided at public expense is deemed to be having recourse to public funds.
§ Lord BELSTEADIt is not practicable to cover all the ways in which a person might have recourse to public funds nor is it possible to generalise on the circumstances in which a person in receipt of a particular form of State aid would be deemed to be covered by the phrase to which the noble Lord draws attention. Cases will be considered on their merits.
