asked Her Majesty's Government:

Whether they have referred any part of the English law of insurance to the Law Commission for their advice.

The LORD CHANCELLOR

The Lord Chancellor has invited the Law Commission to consider the effect on the liability of an insurer, and on the rights of an insured, of:

  1. (a) non-disclosure by, or on behalf of, the insured,
  2. (b) misrepresentation by, or on behalf of, the insured,
  3. 771
  4. (c) breach of "warranty" by the insured,
  5. (d) special conditions, exceptions and terms,
  6. (e) increase and decrease of risk covered,

particularly in the light of the Fifth Report of the Law Reform Committee (1957) and

the draft EEC Directive on the coordination of laws, regulations and administrative provisions relating to insurance contracts, and to make recommendations.
