Mr. Gould

asked the Secretary of State for Education and Science on how many occasions between 1st January and 31st December 1977 local education authorities have applied to her under Section 37(3) of the Education Act 1944 for directions as to which school should be named in a school attendance order in relation to (a) primary schools and (b) secondary schools; and on how many of those occasions was the school directed by her to be named in the order that selected by the parent in relation to (i) primary schools and (ii) secondary schools.

Between 1st January 1977 and 31st December 1977 my right hon. Friend received applications from local education authorities under Section 37(3) of the Education Act 1944 for determinations of the school to be named in school attendance orders in respect of 40 children. All these applications were in relation to secondary schools. The school determined by my right hon. Friend was that selected by the parent in 24 of the cases. Of the remainder, 11 of the applications were withdrawn by the local education authority before a determination had been made and in the other five cases the school determined by my right hon. Friend was that selected by the local education authority. In addition there were four applications in respect of handicapped pupils of primary school age. In two cases the special school determined by my right hon. Friend was that selected by the local education authority: the other two cases are still being considered.
