asked the Attorney-General whether, to relieve pressure of work upon the Director of Public Prosecutions' Office, he will remind chief constables of their right and duty to instigate proceedings under Section 3 of the Obscene Publications Act 1959 without prior consultation with, or prior approval of, the Director of Public Prosecutions.

I have been asked to reply.

Chief constables are required by the Prosecution of Offences Regulations 1946 to report to the Director of Public Prosecutions all obscene publications cases in which it appears there is a prima facie case for prosecution. I have no plans for giving fresh advice to the police as to the stage at which they should consult the Director.
