asked the Secretary of State for the Home Department what percentage of recommendations of mental health review tribunals he rejects.

Advice from a mental health review tribunal in respect of patients subject to the restrictions in Section 65 of the Mental Health Act 1959 was rejected in not quite 16 per cent. of cases during the three years 1973–1975. In such cases, however, there may be a number of issues other than discharge on which a decision has to be taken, and the effect of a rejection is not necessarily to reverse a proposal for the patient to leave hospital. For details of recommendations for discharge specifically I would refer my hon. Friend to the latter part of the reply given on 10th Deceber 1976 by my right hon.
