asked the Secretary of State for Trade if the medical defence bodies are carrying out insurance business as defined by the Insurance Companies Act 1971; and, if so, whether he will ask for any assurance or an undertaking over their administration and financial status.

My officials and legal advisers have been continuing their discussions with major medical defence bodies as to whether they are carrying on insurance business as defined in the Insurance Companies Act 1974. Until this question has been resolved it would not be appropriate for me to seek assurances or undertakings about their administration and financial status. The bodies have, however, indicated that they intend to ensure that their financial position is such that they would meet the requirements of the Insurance Companies Act.
