§ Mr. Spearingasked the Secretary of State for Foreign and Commonwealth Affairs if he will state the occasions where Her Majesty's Ministers act within the structure of the European Communities under the Royal Prerogative.
§ Mr. JuddIn the field of foreign affairs the Government act in exercise of the Royal Prerogative principally to issue passports and to conclude treaties and other international agreements including agreements between member States of the European Communities and between member States and third countries. Those of the latter agreements which are not automatically Community treaties under Section 1(2) of the European Communities Act 1972 fall to be considered for designation as Community treaties by affirmative resolution Order in Council.
