Mr. Freud

asked the Secretary of State for the Environment (1) what representations he has received regarding misunderstandings in respect of Section 278 of the Public Health Act 1936;

(2) if he is satisfied that Section 278 of the Public Health Act 1936 gives adequate protection to persons seeking compensation for loss of profits; and if he will make a statement;

(3) how many claims have been made under Section 278 of the Public Health Act 1936; and what percentage of these have been successful in each of the last 10 years.

Apart from cor-respondance last year with the hon. Member, I have received no representations about Section 278. I am not aware of any reason to review the law, although I am always ready to consider suggestions. No central records of claims are kept.
