Mr. Adley

asked the Secretary of State for Employment if he will review the powers available to industrial tribunals under the Industrial Tribunals (Labour Relations) Regulations 1974 (SI, 1974, No. 1386) so as to ensure that they have sufficient authority to enforce an order to allow access to non-privileged documents, in view of the recent refusal of the National Coal Board to permit the investigation of records of attendance of Mr. Jack Bonsall at Shirebrook Colliery, Nottinghamshire.

Under paragraph 21(6) of Schedule 1 to the Trade Union and Labour Relations Act 1974 any person who fails without reasonable excuse to comply with such an order shall be liable on summary conviction to a fine not exceeding £100. I believe this sanction is sufficient. But my Department has been keeping the matter under review for some time and will continue to do so.
