Mr. Ward

asked the Secretary of State for the Home Department (1) whether he will review the case of Mrs. Narmada Pragji Bharadia (B 281392), in view of the statement in a Home Office letter dated 21st June 1977 that only in January 1977 had the Home Office become aware of Mrs. Bharadia's new address, when a letter dated 15th October 1976 had been sent to that address from Lunar House, Croydon;

(2) whether he will revise the wording of Form APP 101 (Immigration Act 1971) —Refusal to revoke or vary leave to enter) to give the address of the appellate authorities in view of the case of Mrs. Narmada Pragji Bharadia (B 281392), whose relatives notified a change of address to the Home Office, but owing to a postal or other failure the notification was not recorded, and Mrs. Bharadia had no knowledge of appeal proceedings and was subsequently taken to court;

(3) whether he will consider recommending a free pardon to Mrs. Narmada Bharadia (B 281392), who was deprived of her right to representation at an adjudication hearing and subjected to court proceedings, owing to the non-receipt at the Home Office of a change of address notice sent by her nephew, and in view of the procedural weaknesses revealed by this case.

The new address of which the Home Office became aware in January 1977 was not the one to which the letter dated 15th October 1976 was sent. I shall write shortly to my hon. Friend about this case, but I am not aware of any grounds on which it would be right for my right hon. Friend to recommend a free pardon for Mrs. Bharadia; nor am I persuaded that there is a need to revise Form APP 101.
