§ Mr. Brothertonasked the Secretary of State for Social Services under what statutory provision unemployment benefit which has been overpaid to claimants can be recovered.
§ Mr. OrmeSection 119 of the Social Security Act 1975 provides that, where a decision has been reversed or varied on appeal, or revised on review, any benefit that was overpaid as a result of the original decision is to be repaid unless the beneficiary, or any person acting for him, has throughout used due care and diligence to avoid overpayment.
