35. Mr. John H. Osborn

asked the Secretary of State for Trade whether he will take steps to discourage the deliberate winding-up of businesses in one name, the transfer of assets to another name, at the same time leaving unpaid debts to be carried by suppliers already faced with severe cash flow problems.

The Companies Acts and the Bankruptcy Acts provide a substantial measure of protection for creditors in the winding-up of companies and of businesses. Evidence produced of any loopholes in the law which are being commonly exploited will be taken into account in the continuing review of the relevant legislation.
