HC Deb 13 December 1977 vol 941 cc196-7W
Mr. Gwilym Roberts

asked the Secretary of State for Defence what security of tenure in Service tenancies is provided to Service men's wives and families in the event of the Service man's death or the break-up of the marriage; and if he will make a statement.

Dr. Gilbert

Married quarters are provided for Service men and their families 'to enable them, where possible, to remain together wherever they may be posted. The family of a deceased Service man may continue to occupy a quarter for a period of up to six months after his death. During this time the Service welfare authorities assist the family to look for alternative accommodation. Thereafter, action may be taken by the Ministry of Defence to re-possess the quarter but, where the quarter is not immediately required, it is often possible to allow a longer period of time. Should it prove necessary to apply to the courts for a warrant for possession, for which Ministerial approval is required, the Department continues to maintain close contact with the local authorities, to see what help they can provide.

In the event of the break-up of a mar-rage, the family is required to vacate the quarter within a reasonable period of time. Before legal action is taken to repossess the quarter, every effort is made to minimise the difficulties involved in these difficult situations and to assist the parties concerned to find suitable alternative accommodation.
