Mr. Loveridge

asked the Secretary of State for the Home Department under what circumstances the deportation of EEC and other non-Commonwealth nationals may take place by the Home Office other than on the recommendation of courts.

Dr. Summerskill

Section 3(5) of the Immigration Act 1971 provides for deportation if a person,

  1. (a) having only a limited leave to enter or remain, does not observe a condition attached to the leave or remains beyond the time limited by the leave; or
  2. (b) the Secretary of State deems his deportation to be conducive to the public good; or
  3. (c) another person to whose family he belongs is or has been ordered to be deported.
